Terms of service

These terms apply when you use yellowsville.com or order from us. Ordering means you agree to them. They are written to be read, so please do.
1. Who we are
Yellowsville is an independent studio. We are not affiliated with, endorsed by, or connected to any television series, studio, or rights holder.
2. What we sell
We draw the people and pets in your photos as yellow cartoon characters in a scene you choose, and sell the result as a digital file or printed on canvas. Previews are free and unlimited; you pay only when you order. The drawing is made by our illustration software from your photos and our own style and scenes, and an illustrator reviews or corrects it on request. A cartoon is an interpretation: it aims to be recognisably you, not a photographic copy.
3. Your photos and requests
By uploading a photo you confirm that:
- you own it or have permission to use it, and everyone in it (or their parent or guardian, for children) agrees to be drawn;
- it contains nothing unlawful, sexual, hateful or violent;
- your notes do not ask us to copy a trademarked character, logo or another artist's work.
We may decline to draw a photo or a request, and will refund anything you have paid for it. You keep all rights to your photos; you grant us only the licence needed to make and deliver your portrait.
4. Prices, orders and payment
Prices are shown in US dollars. Taxes and delivery, if any, are shown at checkout before you pay. An order is accepted when we send the order confirmation email. If a price is obviously wrong, we may cancel the order and refund you. Payment is taken at checkout through Shopify Payments, PayPal or the other methods shown there.
5. Delivery
Digital files are sent to your email address after your order is confirmed. Canvases are made to order and shipped as described in our Shipping policy. Risk in the goods passes to you when they are delivered to the address you gave.
6. Changes, cancellation and your right of withdrawal
You can change your drawing for free as often as you like before you order. After you order we keep revising it with you until you are happy, and a canvas is printed only once you are. Because every portrait is made to your specification, it cannot be returned and the statutory 14-day right of withdrawal for distance sales does not apply to it (Directive 2011/83/EU, Article 16(c), and equivalent national laws). Damaged or faulty prints are replaced free of charge. The details are in our Refunds and amendments policy. Nothing in these terms limits rights that consumer law gives you and that cannot be excluded.
7. What you may do with the portrait
Once your order is paid you receive a perpetual, worldwide licence to use the portrait for personal, non-commercial purposes: printing, gifting, sharing, using it as a profile picture. Commercial use (merchandise, advertising, resale, use by a business) needs a separate licence; email us, it is usually a flat fee of $99. We do not use your portrait in our marketing unless you say we may.
8. Our work and other people's
Our scenes, character designs, website and name are ours. Yellowsville is an independent studio; we are not affiliated with, endorsed by or connected to any television series, studio or rights holder, and we do not draw their characters.
9. Our responsibility
We are responsible for delivering what you ordered as described. We are not responsible for losses that we could not reasonably foresee, for delays caused by carriers or customs, or for colour differences between your screen and the printed canvas. Nothing here excludes liability for death, personal injury, fraud or anything else that cannot be excluded by law.
10. Law and disputes
These terms are governed by the law of Lithuania. If you are a consumer in the EU or UK you also keep the protection of the mandatory rules of your own country, and you may bring a claim there. If something goes wrong, write to us first; we resolve nearly everything by email. EU consumers can also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
11. Changes to these terms
We may update these terms; the version in force when you order applies to your order.
